BAM Savings, LLC ("BAM Savings," "we," "us," or "our") is a group purchasing organization ("GPO") organized under the laws of the State of New Mexico. This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our website, request membership, apply to become a supplier partner, communicate with us, or otherwise interact with our services.

As a GPO, BAM Savings combines the purchasing power of its members to negotiate contracted pricing with participating suppliers. We are not the seller of record for any product or service. Purchases are made directly between you and the applicable supplier, which sells, invoices, fulfills, ships, supports, and warrants its own products and services.

BAM Savings does not operate in the healthcare industry. Our website and services are intended for general business use and are not designed to collect health information of any kind.

By using our website or submitting information to us, you agree to the practices described in this Privacy Policy.

1. Information we collect

We collect information directly from you, automatically through our website, and from supplier partners, referral sources, and other business sources.

A. Information you provide to us

• Name and job title
• Company or organization name
• Business email address and business phone number
• Whether you are contacting us as a prospective member (a business that buys products and services) or as a prospective supplier partner
• Approximate purchasing volume or spend, if you choose to share it
• Product and service categories you buy or supply
• Invoices, pricing, or purchasing records you voluntarily share so we can identify savings opportunities
• Messages, forms, and other communications you send us
• Account or portal login information, if applicable

B. Membership and supplier-partner information

Because we operate in a business-to-business environment, we may collect and maintain professional information about members, prospective members, supplier partners, and their personnel, including business contact details, purchasing preferences, contracted categories, communication history, lead-source and referral information, and supplier-assigned account identifiers.

C. Information we collect automatically

When you visit our website we may automatically collect technical information such as IP address, browser and device type, operating system, pages viewed, referring website, date and time of visit, approximate location derived from IP address, website usage and analytics data, and cookie or similar identifiers. D. Information we do not want

Please do not submit Social Security numbers, government identification numbers, payment card numbers, bank account details, passwords, or any health or medical information through our general website forms. If we receive such information, we may delete it or return it and handle it in accordance with applicable law.

• Responding to membership and supplier-partner inquiries
• Evaluating and enrolling members, and onboarding supplier partners
• Identifying contracted pricing and savings opportunities relevant to what a member buys
• Connecting members with participating suppliers and linking contracted pricing to a member's existing supplier accounts
• Administering GPO contracts, including tracking member purchasing volume for contract compliance and administrative-fee reporting
• Managing member and supplier relationships and providing support
• Sending business communications, and marketing or educational communications where permitted
• Improving our website, services, and operations
• Maintaining security and preventing fraud, spam, and abuse
• Complying with legal, regulatory, tax, accounting, and contractual obligations
• Enforcing our agreements, terms, and policies

We may also create aggregated, de-identified, or anonymized data (for example, combined purchasing volume across members) that does not reasonably identify you or your organization, and use it for any lawful purpose.

3. How we share information

A. Participating suppliers

We share information with participating suppliers when necessary to enroll a member in a contract, connect contracted pricing to a member's account, confirm eligibility, support supplier follow-up, or administer a GPO contract. Each supplier is responsible for its own privacy practices, order processing, invoicing, fulfillment, shipping, returns, warranties, product support, and customer relationships.

B. Service providers

We share information with third-party providers that help us operate our business, such as website hosting, customer-relationship-management (CRM) platforms, email and communication tools, form and bot-protection services, analytics providers, cloud storage, cybersecurity, IT support, and professional advisors. These providers may use information only as needed to provide services to us or as otherwise permitted by law.

C. Business partners and referral sources

We may share business contact and referral information with business or referral partners where necessary to support member enrollment, supplier development, or account management.

D. Legal, compliance, and safety

We may disclose information when we believe it is necessary to comply with applicable law, regulation, subpoena, or legal process; respond to lawful requests from public authorities; enforce our contracts, terms, or policies; protect the rights, property, safety, or security of BAM Savings, our members, our suppliers, or others; or detect, prevent, or investigate fraud, security incidents, or unlawful activity.

E. Business transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction.

4. Supplier products, orders, and complaints

If you contact us about a supplier's product or service — including pricing, availability, order status, delivery, returns, warranties, quality, or complaints — we may forward your communication and contact information to the applicable supplier. BAM Savings does not make product, warranty, or fulfillment determinations; those are handled by the supplier.

5. Cookies and tracking technologies

We may use cookies, pixels, tags, analytics tools, and similar technologies to operate our website, remember preferences, understand traffic, analyze performance, improve the experience, and measure the effectiveness of outreach. You can control cookies through your browser settings; disabling cookies may affect website functionality. Our lead form may use a bot-protection service that sets its own cookies or collects device signals to distinguish people from automated traffic.

6. Marketing communications

We may send business, educational, promotional, or marketing communications to members, prospective members, supplier partners, and other business contacts. You may opt out of marketing emails by using the unsubscribe link in those emails or by emailing us at hello@bamsavings.com. Even if you opt out, we may still send non-marketing communications related to your inquiries, membership, contracts, or our business relationship.

7. Data security

We use reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Data retention

We retain information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to respond to inquiries, maintain membership and contract records, track purchasing volume and administrative fees, comply with legal, tax, accounting, and contractual obligations, resolve disputes, enforce agreements, and maintain security and fraud-prevention records. Retention periods vary depending on the type of information and our relationship with you.

9. Your privacy choices

Depending on where you live and applicable law, you may have rights to request access to personal information we maintain about you, request correction of inaccurate information, request deletion of certain information, request information about how we disclose personal information, opt out of certain marketing communications, limit certain uses or disclosures, and appeal certain decisions.

Categories of personal information we may collect: identifiers (such as name, business email, phone number, IP address); professional or employment-related information (such as job title and employer); commercial information (such as categories purchased or supplied, purchasing volume, and contract participation); internet or network activity (such as website usage data); approximate geolocation derived from IP address; and inferences drawn from business interactions (such as categories of interest).

Purposes: the purposes described in this Privacy Policy, including membership enrollment, supplier coordination, contract administration, support, analytics, security, legal compliance, and business operations.

Disclosure: to participating suppliers, service providers, business partners, professional advisors, and other parties as described in this Privacy Policy.

Sale or sharing: we do not sell personal information for money. If we use advertising or analytics technologies that may be considered a "sale" or "sharing" under California law, we will provide any required notice and opt-out mechanism.

11. Other state privacy rights

Residents of other states may have additional rights under applicable state privacy laws, which may include access, correction, deletion, portability, opt-out, and appeal rights. To submit a request, email hello@bamsavings.com. We will respond as required by applicable law.

12. Children's privacy

Our website and services are intended for business users. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have, we will take appropriate steps to delete it.

13. Third-party and supplier websites

Our website may link to supplier websites, ordering portals, or other external resources. We are not responsible for the privacy practices, security, or content of third-party websites. When you interact with a supplier, that supplier's own privacy policy and terms apply.

14. International users

Our website and services are intended for users located in the United States. If you access our website from outside the United States, you understand that information may be processed in the United States, which may not provide the same level of data protection as your location.
